2. Scope of Services, Company's Role, and Absolute Dependency on Supplier Terms

2.1. Our Predominant Role as Intermediary/Agent: For the overwhelming majority of the Services offered, particularly those involving distinct, separately provided components (e.g., flight bookings, hotel reservations, bus/train tickets, theme park tickets, and specifically, Daily/Weekly Tours operated by State Tourism Development Departments, or individual components within Special Flight Packages (e.g., the flight segment, the temple darshan component, hotel stay)), the Company acts solely and exclusively as an agent, facilitator, or booking aggregator between you and the respective Supplier(s). In such instances:

  • We facilitate the booking process and collection of payment on your behalf, transmitting your request and payment to the relevant Supplier.
  • Your direct contractual relationship for the actual provision of that specific service component (e.g., the act of flying, the hotel stay, the State Tourism Department coach journey, the temple darshan entry, the bus/train travel) is established directly between you and the respective Supplier.
  • Therefore, you unequivocally agree to be bound by, and strictly adhere to, all terms and conditions, cancellation policies, refund policies, rules of carriage, rules of stay, rules of entry, operational guidelines, safety protocols, and liability limitations explicitly imposed by these individual Suppliers. These Supplier terms are paramount and are incorporated by reference into your agreement with us. We strongly advise you to meticulously review and understand these Supplier terms, which are often accessible on the Supplier's own websites or provided by us upon request.

2.2. Our Limited Role as Principal/Organizer: For a highly specific and limited set of services where the Company directly contracts and fully operates the entire service (e.g., certain bespoke private car tours where the vehicle and driver are exclusively managed by us, or specific ground handling services where explicitly stated), we act as the principal service provider. This will be unambiguously indicated in the Service-Specific Terms for such particular offerings. Our liability in such cases is detailed in Section 8.

2.3. Accuracy of Service Descriptions and Supplier Information: All descriptions, itineraries, images, videos, and information pertaining to Services displayed on our Website, in our brochures, or marketing materials are provided in good faith. This information is primarily based on data, representations, and materials furnished by our Suppliers. While we undertake commercially reasonable efforts to ensure accuracy and to reflect the Services as faithfully as possible at the time of publication, we do not warrant or guarantee that all such information is entirely free from errors, omissions, or may not have become outdated due to changes by Suppliers. Features, facilities, amenities, inclusions, operational timings, and specific details are subject to unilateral modification by Suppliers without prior individual notice to us or to you.

3. Eligibility and Capacity to Contract

By utilizing our Website and/or Services, you explicitly represent and warrant that you are at least eighteen (18) years of age, possess the full legal capacity, authority, and competence to enter into a legally binding agreement under the provisions of the Indian Contract Act, 1872, and are not disqualified from contracting by any applicable law.

If you are making a booking on behalf of other individuals, a group, or a corporate entity, you unequivocally confirm that you possess the full legal authority, and explicit consent where required, to act as their agent, to bind them to these General T&Cs, any applicable Service-Specific T&Cs, and the terms of the relevant Suppliers. You shall be solely responsible for ensuring that all other participants are fully informed of and agree to these terms and conditions applicable to their booking.

4. Booking Procedure, Confirmation, and Essential Customer Obligations

4.1. Absolute Responsibility for Information Accuracy: You, the Customer, bear the sole and absolute responsibility for providing accurate, complete, current, and verifiable personal information and travel details during the entire booking process. This critical information includes, but is not limited to:

  • The full legal names of all travelers as they appear exactly on their official Government-issued photo identification documents (e.g., Passport, Aadhar Card, Driving License, Voter ID) for all bookings, particularly for flights, trains, buses, and tours that require ID verification.
  • Precise and verifiable contact details (primary and secondary email addresses, mobile phone numbers, residential address).
  • Any specific requirements, preferences (e.g., dietary restrictions, seating preferences, mobility assistance), or pre-existing medical conditions that may affect your participation or safety (which must be communicated for our assessment and consideration by Suppliers).
  • Correct dates, times, origins, and destinations for all service components.

Failure to provide accurate, complete, or timely information, or providing misleading information, shall lead to severe consequences for which the Company bears no liability. These consequences may include, without limitation:

  • Immediate denial of boarding, entry, or service by Suppliers (e.g., airlines, hotels, bus operators, State Tourism Departments, pilgrimage sites, event venues) without any refund entitlement.
  • Automatic cancellation of booking(s) or individual service components without refund.
  • Imposition of additional costs for re-booking, re-issuance of tickets, name corrections, itinerary changes, or penalties levied by Suppliers.
  • Significant inconvenience, disruption to your travel plans, or complete loss of the booked Service.

4.2. Service Availability: All Services are strictly subject to availability at the precise time of confirmed booking and payment. Prices and availability are dynamic and may change rapidly, without prior notice, until a booking is definitively confirmed and a Booking Confirmation is issued by the Company.

4.3. Payment Obligations: Full payment, or an agreed-upon non-refundable deposit (as specifically stipulated for each Service or package), is unequivocally required at the time of booking. The specific payment schedule (e.g., phased payments for multi-day tours, full upfront for flights/tickets) will be clearly indicated in the Service-Specific Terms and the booking invoice. We accept payments via [List explicitly accepted payment methods, e.g., major credit/debit cards (Visa, MasterCard, RuPay), Unified Payments Interface (UPI), Net Banking, specific secure payment gateway providers like Razorpay, PayU]. All payments are processed securely through our authorized third-party payment partners.

4.4. Issuance of Booking Confirmation: A Service is considered officially confirmed and a binding contract between you and the Company (for our services) or the Supplier (for their services) is established only upon our receipt of the required full payment or deposit AND our subsequent issuance of a formal Booking Confirmation. This confirmation will typically be dispatched via email to the primary email address provided by you. It is your immediate and critical responsibility to meticulously review your Booking Confirmation, including all participant names, dates, timings, and inclusions, for any discrepancies, errors, or omissions. You must notify us in writing (via email to our Customer Service Email ID connect@easemyyatra.com of any errors or issues within twenty-four (24) hours of receipt of the Booking Confirmation. Failure to do so will be deemed as your unconditional acceptance of the booking details as confirmed and displayed therein.

4.5. Mandatory Proof of Identity and Travel Documents: It is an absolute mandatory requirement for all Customers to possess and carry a valid Government-issued photo identification document (e.g., Aadhar Card, Passport, Driving License, and Voter ID) throughout the entire duration of the Service. For international travel, possession of a valid Passport with sufficient remaining validity (typically 6 months beyond the return date) and all necessary visas for the destination country and any transit countries is indispensable.

  • Specific Requirement for State Tourism Department Tours: Strict identity verification is typically mandated by State Tourism Departments for boarding their coaches. You must present the same ID used for booking.
  • Specific Requirement for Pilgrimage Tours (including Special Flight Packages to Shirdi/Tirupati): Pilgrimage site authorities (e.g., TTD for Tirupati, Shri Saibaba Sansthan Trust for Shirdi) have stringent ID requirements, specific Darshan entry rules (e.g., biometric verification, pre-booked slot adherence), and strict dress codes. You are solely responsible for adhering to these directives.
  • Failure to produce valid, matching identification or necessary travel documents (including visas) upon demand by the Company, Supplier, or relevant authorities (e.g., airport security, hotel check-in, bus conductor, temple security) will inevitably result in immediate denial of boarding, entry, or service by the Supplier or authorities, without any entitlement to refund or compensation from the Company.

5. Pricing Structure, Inclusions, and Explicit Exclusions

5.1. Price Basis: All prices for Services are quoted in Indian Rupees (INR) unless explicitly stated otherwise. Prices are as displayed on our Website or quoted by our authorized representatives at the time of inquiry or booking. Prices are dynamic and are subject to immediate change without prior individual notice until a booking is fully confirmed and the required payment is received by the Company.

5.2. Explicit Inclusions: The price you pay for any Service unequivocally includes only those specific services, facilities, amenities, meals, and applicable taxes that are explicitly and clearly itemized and mentioned in the "Inclusions" section of the Service-Specific Terms on the respective product/booking page, or as detailed in your final Booking Confirmation. No other services or items are included unless specifically stated.

5.3. Explicit Exclusions: The price explicitly and unequivocally excludes all items and services not specifically listed as "Inclusions." This comprehensive list of typical exclusions comprises, but is not limited to:

  • Visa fees, passport costs, international/domestic airport taxes, air ticket fare (unless the specific package explicitly states their inclusion).
  • Optional activities, excursions, sightseeing tours, entry tickets to monuments/attractions, room/vehicle upgrades, or any additional services not itemized as included in the itinerary.
  • Meals, snacks, and beverages (alcoholic or non-alcoholic) unless specifically mentioned as included in a meal plan (e.g., "Breakfast Only").
  • All personal expenses, including but not limited to shopping, laundry, phone calls, internet usage charges (Wi-Fi), mini-bar consumption, medical expenses, medicines, costs for any special requests not explicitly confirmed as included.
  • Gratuities or tips for guides, drivers, porters, hotel staff, or any other service personnel.
  • Any form of personal insurance (e.g., comprehensive travel insurance, medical insurance, baggage insurance, trip cancellation/interruption insurance). Customers are emphatically and strongly advised to procure comprehensive personal travel insurance covering unforeseen circumstances, medical emergencies, cancellations, and baggage loss/damage for all travel.
  • Excess baggage charges, special baggage handling fees (e.g., for oversized sports equipment), or porterage charges.
  • Any costs incurred directly or indirectly due to unforeseen circumstances or Force Majeure Events (refer to Section 6.2).
  • Any new taxes, levies, surcharges, statutory fees, or government-imposed charges that may be introduced or increased by central, state, or local authorities after the booking confirmation date.
  • Any costs arising from your non-compliance with Supplier rules, local laws, or these General T&Cs.

5.4. Foreign Exchange Rate Fluctuations (for International Services): For international Services or packages involving foreign currency components, the final price may be subject to adjustments based on significant fluctuations in foreign exchange rates until full and final payment is received by the Company. Any such adjustments will be communicated to you prior to final payment.

6. Rigorous Policies for Changes, Cancellations, and Refunds

6.1. Customer-Initiated Changes and Cancellations:

  • Absolute Policy Specificity: Due to the inherently diverse nature and operational variabilities across our Services, and our predominant role as an intermediary, the precise cancellation, change, and refund policies will vary significantly for each distinct Service and will be almost entirely dictated by the individual Supplier's (e.g., airline, hotel, State Tourism Department, private bus operator, pilgrimage authority) specific terms, fare rules, and regulations.
  • Unambiguous Binding Nature of Supplier Policies: You are unequivocally bound by, and agree to strictly adhere to, the cancellation, change, and refund policies of the respective Suppliers. These policies are often rigid, non-negotiable, and may involve substantial cancellation fees, re-booking charges, or may result in the booking being entirely non-refundable, especially for discounted fares, special promotional packages (e.g., Special Flight Packages to pilgrimage sites), or last-minute changes.
  • Mandatory Review of Service-Specific Terms: It is an absolute requirement that you refer to and thoroughly understand the detailed Service-Specific Terms and Conditions displayed on the individual product/booking page for each Service (e.g., specific flight fare rules, hotel cancellation deadlines, State Tourism Department cancellation policies for their coach tours) or provided separately in writing during the booking process. These specific terms will supersede the general terms for that particular aspect where a conflict exists.
  • Strict Cancellation Request Procedure: All requests for changes or cancellations must be submitted by the Customer strictly in writing via email to writing our Customer Service Email ID connect@easemyyatra.com or through the designated cancellation option on our Website (if available and enabled for your specific booking). The change or cancellation will be deemed effective only from the verifiable date and time we receive your valid written request.
  • "No-Shows" - No Refund Policy: Failure to show up for a confirmed Service at the designated time and location (e.g., flight departure, bus boarding, tour pick-up point, hotel check-in time, pilgrimage site entry slot), or arriving excessively late and missing the Service, will be irrevocably considered a "no-show." No-shows are strictly not eligible for any refund whatsoever, as per the standard policies of most Suppliers and the Company.
  • Refund Processing (If Applicable): Refunds, if determined to be applicable as per the specific Service's and Supplier's policy, will be processed by the Company within [e.g., 7-14] business days of receiving the valid written cancellation request AND after our receipt of the refund amount from the respective Supplier. The refund will be credited back exclusively to the original mode of payment used during booking, unless mutually agreed otherwise.
  • Deduction of Charges: Any bank charges, payment gateway processing fees, currency conversion fees, or other transactional charges incurred during the original payment and/or the refund process will be exclusively borne by the Customer and will be deducted from the refundable amount.
  • Company Administrative Fees: All changes or cancellations initiated by the Customer will incur non-refundable administrative fees from the Company, in addition to any charges or penalties levied directly by Suppliers. These administrative fees will be clearly communicated to you at the time of your request.

6.2. Cancellations and Modifications by Company / Suppliers (Force Majeure Events):

Unforeseen Circumstances (Force Majeure): We, or our Suppliers (including, but not limited to, airlines, hotels, train operators, bus operators, State Tourism Development Departments, pilgrimage site authorities, and event venues), reserve the absolute and unequivocal right to cancel, postpone, or significantly modify any Service, its itinerary, or its operational details due to unforeseen circumstances beyond our or their reasonable control ("Force Majeure Events"). These events include, but are not limited to:

  • Acts of God: Natural calamities such as floods, earthquakes, volcanic eruptions, landslides, severe weather conditions (e.g., cyclones, tsunamis, heavy snowfall), extreme heatwaves, or other natural disasters.
  • Public Health Emergencies: Epidemics, pandemics (including COVID-19 related impacts), outbreaks of contagious diseases, or government-imposed restrictions related to public health (e.g., lockdowns, quarantines, travel bans).
  • Socio-Political Instability: War (declared or undeclared), civil disturbance, riots, bandhs, curfews, political unrest, acts of terrorism, or significant security concerns.
  • Governmental Actions: Government directives, travel advisories, border closures, changes in regulations, or imposition of new taxes/levies that render the Service unsafe, impractical, or commercially unviable.
  • Operational Issues: Significant operational disruptions, including but not limited to: vehicle/aircraft/train breakdown, severe road blockages, unavailability of suitable transport, or critical infrastructure failures.
  • Site Closures: Unanticipated closure of attractions, monuments, routes, pilgrimage sites, venues, or access points by authorities or due to unforeseen circumstances.
  • Minimum Participant Requirement: Insufficient number of participants to operate a specific Service (if a minimum number is specified in the Service-Specific Terms for that Service).
  • Any other event or circumstance beyond the Company's or the Supplier's reasonable control that materially impacts the feasibility, safety, or legality of conducting the Service as planned.

Notification Protocol: In the event of such cancellation or significant modification due to a Force Majeure Event, we will endeavor to notify you as soon as reasonably possible using the primary contact details (email and/or phone) provided at the time of booking.

Limited Alternatives/Refunds for Force Majeure: If a Service is cancelled by us or our Supplier prior to departure due to a Force Majeure Event, we will offer you, at our sole discretion and subject to Supplier policies:

  • An alternative date for the same Service (if available and feasible).
  • A credit for a future booking of equivalent value with the Company.
  • A refund of the amount paid by you for that specific Service. However, please be advised that such refunds may be subject to the non-recoverable components of the Supplier's costs (e.g., non-refundable flight tickets, pre-paid permits, non-refundable hotel deposits, administrative processing fees levied by the Supplier) and our reasonable administrative charges for handling the cancellation.

Minor Modifications: If a Service is subject to minor modifications (e.g., minor changes in itinerary sequence, substitution of a similar quality vehicle type, slight timing adjustments, substitution of an attraction/venue with an equivalent one due to unavoidable circumstances), we will make commercially reasonable efforts to provide an equivalent alternative. No refunds or compensation will be provided for minor modifications that do not fundamentally alter the essence, duration, or value of the Service.

Strict Limitation of Liability for Force Majeure: Our liability for cancellation or significant modification by us or our Suppliers due to a Force Majeure Event is strictly and absolutely limited to the refund/credit of the amount paid by you for that specific affected Service, as determined by us. Under no circumstances shall the Company be liable for any indirect, incidental, consequential, special, punitive, or exemplary losses, expenses, or damages incurred by you, including but not limited to costs related to non-refundable connecting flights, separate accommodation arrangements, alternative transport, visa application fees, loss of earnings, loss of enjoyment, emotional distress, or any other independent travel arrangements or financial commitments arising from such cancellation or modification. You are advised to obtain appropriate travel insurance to mitigate such risks.

7. Customer Conduct, Responsibilities, and Compliance

7.1. Punctuality and Adherence to Timings: Customers are required to adhere strictly and punctually to all designated timings for all Service components (e.g., flight/train/bus departure times, tour pick-up times, meeting points, hotel check-in/out times, Darshan timings for pilgrimage tours). Any delays caused by Customers will inevitably result in missed connections, forfeiture of participation in parts of the Service, or the entire Service, with absolutely no entitlement to refund or compensation. For State Tourism Department Tours & Bus Service, strict adherence to boarding times and schedules is paramount, as their coaches operate on fixed schedules and will not wait for late passengers beyond the announced departure time.

7.2. Strict Compliance with Rules: You expressly agree to strictly abide by all rules, regulations, and instructions provided by our staff, tour managers, guides, drivers, and all relevant Suppliers (e.g., airline rules of carriage, hotel policies, park regulations, local laws, traffic laws, State Tourism Department rules, pilgrimage site regulations, venue rules for events, visa regulations). Any failure to comply with these rules may lead to immediate termination of your Service without refund or recourse.

7.3. Expected Behavior: Customers are expected to conduct themselves in a respectful, courteous, and considerate manner towards fellow participants, our staff, Supplier personnel, local residents, and the environment. Any unruly, disruptive, offensive, abusive, aggressive, illegal, or disrespectful behavior, or actions that show disrespect towards local customs, traditions, religious sentiments, or public decency, may result in immediate termination of the Service without refund. The Company reserves the unequivocal right to involve local law enforcement authorities if deemed necessary.

7.4. Health, Fitness, and Special Needs: You are solely responsible for ensuring that you and all members of your party are medically and physically fit for the chosen Service. Please inform us in writing at the time of booking if any participant has specific health conditions, severe allergies, mobility needs, or requires special assistance. While we will endeavor to communicate reasonable requests to Suppliers, we cannot guarantee their fulfillment. Not all Services may be suitable for all individuals (e.g., adventure activities requiring a specific fitness level, long coach journeys, or extensive walking at pilgrimage sites). We reserve the right to advice on suitability and may require a medical certificate in certain cases. Participation in adventurous activities carries inherent risks, and you acknowledge and accept these risks.

7.5. Prohibited Items: Carrying illegal substances, prohibited weapons, explosives, hazardous materials, or any items deemed unsafe, dangerous, or prohibited by Indian law, international regulations, or Supplier regulations (e.g., airline baggage restrictions, temple security rules, park regulations) is strictly forbidden on our premises or during any Service. Any such discovery may lead to immediate termination of service and involvement of authorities.

7.6. Baggage Regulations: You must strictly observe the baggage limits and policies for flights, trains, and coaches as specified by the respective Suppliers. For State Tourism Department Coaches (Multi-Axle), specific baggage restrictions regarding size, weight, and number of bags may apply, which will be detailed in the Service-Specific terms. The Company is not responsible for any loss, theft, damage, or delay of personal belongings, luggage, or valuables during the Service, including during transfers, at hotels, or on public transport.

7.7. Children/Minors: Children (individuals under 18 years of age) must be accompanied by a responsible adult (parent or legal guardian) at all times during the Service. Specific age restrictions, height/weight limits, or supervision requirements may apply to certain Services (e.g., adventure activities, certain components of flight packages, children's park entry), as detailed in the Service-Specific T&Cs. The accompanying adult is solely responsible for the safety, conduct, and supervision of the minor(s).

8. Strict Limitation of Liability and Indemnification

8.1. Absolute Limitation of Our Liability (Agency Role): When the Company acts solely as an agent or facilitator for Suppliers (as unequivocally defined in Section 2.1), our liability is strictly and absolutely limited to the diligent selection of such Suppliers based on reasonable industry standards and the proper transmission of your booking details and payments to them. We explicitly and unequivocally disclaim any and all liability for any direct, indirect, incidental, consequential, special, punitive, or exemplary loss, damage, injury, illness, accident, death, delay, discomfort, or any other irregularity arising from, but not limited to, the acts, omissions, defaults, negligence, delays, failures, or breach of contract of such Suppliers, or for any defect in their services or products. Your sole and exclusive recourse for any issues, damages, or claims arising directly from the services provided by these Suppliers (e.g., flight delays/cancellations, hotel service deficiencies, bus breakdowns, temple entry issues, event failures) lies directly and solely with the respective Supplier.

8.2. Limitation of Our Liability (Principal Role): When the Company acts as the principal service provider for specific services directly operated by us, our liability for any direct loss or damage arising solely from our proven gross negligence or deliberate breach of contract is limited to the total amount paid by you for that specific Service. We shall not be liable for any indirect or consequential losses even in such cases.

8.3. Explicit Exclusion of Liability for External Factors and Customer Actions: We shall under no circumstances be liable for any injury, illness, loss, damage (including but not limited to loss of enjoyment, emotional distress, loss of data, loss of profits, or business interruption), accident, death, delay, discomfort, increased expenses, consequential loss, indirect loss, special damages, or any other irregularity howsoever caused, arising directly or indirectly from:

  • Acts of God or any Force Majeure Events (as exhaustively defined in Section 6.2).
  • War (declared or undeclared), civil disturbance, acts of terrorism, riots, political instability, or government directives.
  • Government actions, border closures, changes in laws or regulations affecting travel.
  • Medical or health issues, personal accidents, or unforeseen emergencies experienced by the Customer during the Service.
  • Theft, loss, or damage to personal property, luggage, valuables, or money.
  • Any act, omission, negligence, default, or failure of a third-party Supplier or other persons not directly employed by us (e.g., airline staff, hotel staff, State Tourism Department staff, or individuals at pilgrimage sites).
  • Your own failure to comply with instructions, warnings, these General T&Cs, Service-Specific T&Cs, Supplier rules, or applicable laws.
  • Your own negligence, reckless conduct, or the negligence/misconduct of any member of your party.

8.4. No Guarantees on Timings, Weather, Darshan, or Itinerary Rigidity: We provide estimated timings for flights, trains, buses, and tours. However, we do not guarantee strict adherence to published timings as these can be affected by factors entirely beyond our control (e.g., air traffic control, railway delays, road traffic, weather conditions, and operational issues). We cannot guarantee specific weather conditions during your travel. For pilgrimage packages (including Special Flight Packages), while we facilitate Darshan/entry as part of the package, we do not guarantee specific timings, duration, or nature of Darshan (e.g., VIP Darshan, specific rituals) as it is solely subject to the rules, schedules, crowd management, and security protocols of the respective temple authorities (e.g., TTD, Shri Saibaba Sansthan Trust), which may change without notice. Minor itinerary variations or changes in the sequence of visits during tours (including State Tourism Department tours) may occur due to operational necessities, local conditions, or unforeseen circumstances without prior notice or compensation.

8.5. Indemnification Clause: You expressly agree to indemnify, defend, and hold harmless EASEMYYATRA, its directors, officers, employees, agents, affiliates, and assigns from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements on a full indemnity basis) arising directly or indirectly out of or in connection with:

  • Your use of our Services or Website.
  • Any actual or alleged breach by you of these General T&Cs, any applicable Service-Specific T&Cs, or any terms, conditions, or rules of any Supplier.
  • Your violation of any applicable law, regulation, or the rights of any third party (including intellectual property rights).
  • Any negligent or willful misconduct by you or any member of your party.

9. Intellectual Property Rights (Strict Protection)

All content, including but not limited to text, images, graphics, photographs, logos, Service descriptions, itineraries, unique concepts, software, Website design, audio-visual materials, and branding, displayed on this Website or used in connection with our Services, is the exclusive property of EASEMYYATRA or its licensors. Any unauthorized use is a direct violation of our intellectual property rights and will result in stringent legal action.

10. Privacy Policy (Integral Component)

Your privacy and the meticulous protection of your personal data are of utmost importance to us. Your communication must include your full name, booking reference number, precise details of the grievance, and any supporting documentation (e.g., photographs, receipts).
